4.3 Financial transactions related to our website and services are or may be handled by our payment service providers: Shopify Payments (Shopify International Limited, Ireland), PayPal (PayPal Europe S.à r.l. et Cie, S.C.A., Luxembourg) and Klarna (Klarna Bank AB (publ), Sweden). We also accept bank transfer, in which case the transaction data is handled by our bank. We will share transaction data with our payment service providers only to the extent necessary for the purposes of processing your payments, refunding such payments, and addressing complaints and inquiries related to such payments and refunds. 5. International transfers of your personal data 

5.1 In this Section, we provide information about the circumstances in which your personal data may be transferred to countries outside the European Economic Area (EEA). 

5.2 We and the other companies in our group have offices and facilities in Spain and in the United Kingdom. The European Commission has taken an "adequacy decision" with respect to the data protection laws of the United Kingdom. Where a transfer is not covered by an adequacy decision, it is protected by appropriate safeguards, namely the standard data protection clauses adopted by the European Commission, a copy of which may be obtained by writing to info@skirmshop.es. 

5.3 Our website is hosted by Shopify International Limited (Ireland), part of the Shopify Inc. group (Canada), on facilities located in the European Union. In the course of providing that service, data may be transferred to Canada and to the United States. The European Commission has taken "adequacy decisions" with respect to Canada (for commercial organisations) and, under the EU–US Data Privacy Framework, with respect to certified organisations in the United States. Transfers not covered by an adequacy decision are protected by the standard data protection clauses adopted by the European Commission, which form part of Shopify’s data processing addendum, available at https://www.shopify.com/legal/dpa. 

5.4 Our payment providers, our web analytics provider, our affiliate-tracking provider and our carriers are located in the European Union, the United Kingdom and the United States. The European Commission has taken an "adequacy decision" with respect to the United Kingdom and, under the EU–US Data Privacy Framework, with respect to certified organisations in the United States. Transfers not covered by an adequacy decision are protected by the standard data protection clauses adopted by the European Commission, a copy of which may be obtained by writing to info@skirmshop.es. 

5.5 You acknowledge that personal data you send for publication via our website or services (for example, a product review) may be available, via the Internet, worldwide. We cannot prevent the use (or misuse) of such personal data by third parties.

 

6. Retention and deletion of personal data 

6.1 This Section sets out our data retention policies and procedures, which are designed to help ensure that we comply with our legal obligations regarding the retention and deletion of personal data. 

6.2 Personal data that we process for any purpose or purposes will not be kept longer than necessary for that purpose or those purposes. 

6.3 We will retain your personal data as follows:

a) Transaction data, invoicing data and the accounting records associated with your orders are retained for six (6) years from the end of the contractual relationship, in accordance with Article 30 of the Spanish Commercial Code, and in any event for the four (4) year limitation period laid down in Article 66 of the Spanish General Tax Act (Ley 58/2003). 

b) Where we are required to record the sale of a replica, the sales register associating the serial number with the purchaser’s DNI is retained for the period required by the Spanish Firearms Regulation (Reglamento de Armas, Real Decreto 137/1993) and is made available to the competent authorities. 

c) Account data and profile data are retained for as long as your account remains open and for three (3) years after your last activity, after which the account is deleted or anonymised. 

d) Notification data (newsletter) is retained until you withdraw your consent or unsubscribe.    

6.4 In some cases, it is not possible for us to specify in advance the periods for which your personal data will be retained. In such cases, we will determine the retention period based on the following criteria: 

a) the retention period of usage data and correspondence data will be determined by the time needed to deal with the relevant query, claim or dispute and, thereafter, by the applicable statutory limitation periods. 

6.5 Without prejudice to the other provisions of this Section 6, we may retain your personal data when such retention is necessary to comply with a legal obligation to which we are subject, or to protect your vital interests or the vital interests of another natural person.

8.12 To the extent that the legal basis for our processing of your personal information is consent, you have the right to withdraw that consent at any time. The withdrawal will not affect the lawfulness of processing before the withdrawal.

9. About cookies

9.1 A cookie is a file containing an identifier (a string of letters and numbers) that a web server sends to a web browser and is stored by the browser. The identifier is then sent back to the server each time the browser requests a page from the server.

14. Processing and User Data

In compliance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the guarantee of digital rights (LOPDGDD), SkirmShop Spain SL, CIF B02642775, with registered office at Ronda de Santa Eulàlia 14, 08780 Pallejà (Barcelona), informs its customers that it acts as data controller for the personal data they provide. Those data are processed in order to manage orders and their invoicing, to comply with our legal obligations, and — where you have consented — to send commercial offers and proposals. 

All SkirmShop Spain SL customers may exercise their rights of access, rectification, cancellation, or opposition at any time by communicating in writing via email to info@skirmshop.es indicating in the subject line of the email "PRIVACY POLICY".

Similarly, it is hereby notified that SkirmShop Spain SL does not trade with the data of its customers and users, so such data is not transferred to third parties for profit-making purposes. On the other hand, the current legislation applicable to the products traded by SkirmShop Spain SL may require us to share customer and user data with certain public administrations, as well as with State Security Forces and Corps. For example, the reporting of replica sales must be submitted to the relevant authorities, such as the Guardia Civil, associating the serial number of the weapon purchased by the customer with their DNI. 

Similarly, SkirmShop Spain SL is not responsible for fraudulent or erroneous data that may have been provided to us by customers and users of our services. Therefore, the user or customer will be responsible for the data provided, bearing the consequences that such acts may entail.
